Agreement to Terms
By creating an account or using LitAcademy ("the Service"), you agree to these Terms of Service. If you are creating an account on behalf of a child, you represent that you are the child's parent or legal guardian and that you consent to these terms on their behalf.
Description of Service
LitAcademy is an adaptive literacy learning platform for children in kindergarten through 5th grade. The Service provides personalized reading, writing, and speaking instruction through interactive lessons, AI-powered assessment, and progress tracking.
Accounts and Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create a parent account.
- Student profiles are created and managed by parents. Children do not create their own accounts.
- You are responsible for maintaining the security of your account credentials and for all activity under your account.
- You agree to provide accurate information when creating your account and to keep it up to date.
Parental Consent
By creating a student profile for your child, you consent to the collection and use of your child's information as described in our Privacy Policy. This includes the processing of audio recordings and written responses by AI services for educational assessment purposes.
Subscriptions and Payment
- LitAcademy may offer free and paid subscription plans. Features available under each plan may vary.
- Paid subscriptions are billed on a recurring basis (monthly or annually) as specified at the time of purchase.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change pricing with reasonable notice. Price changes will not affect your current billing period.
- Refunds may be issued at our discretion. If you are unsatisfied, contact us within 30 days of purchase.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with the proper functioning of the Service
- Share your account credentials with others or allow others to access your account
- Use automated tools to scrape, copy, or reproduce the Service's content or curriculum
- Reverse engineer or attempt to extract the source code of the Service
AI-Generated Content
LitAcademy uses artificial intelligence to generate educational content, assess student work, and provide feedback. While we strive for accuracy and quality:
- AI-generated content is reviewed for quality but may occasionally contain errors.
- AI assessment and feedback is designed to be educational and encouraging, but should not be considered a substitute for professional educational evaluation.
- We continuously monitor and improve the quality of AI-generated content and assessments.
Intellectual Property
- The Service, including its curriculum, content, design, and technology, is owned by LitAcademy and protected by intellectual property laws.
- Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial educational purposes.
- Student-created content (written responses, recordings) remains associated with the student's account and can be deleted by the parent at any time.
Disclaimers
- LitAcademy is a supplemental educational tool and is not intended to replace classroom instruction or professional tutoring.
- We do not guarantee specific learning outcomes. Progress depends on consistent use and individual factors.
- The Service is provided "as is" without warranties of any kind, express or implied.
Limitation of Liability
To the maximum extent permitted by law, LitAcademy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.
Changes to Terms
We may update these terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
